Terms of Service

The service is a managed integration layer on top of Google Vertex AI Search (Discovery Engine) and Gemini. We provide access to Google's technology and a convenient wrapper (widget, dashboard, billing); the search and answer generation are performed by Google's models and infrastructure. By using the service, you accept these terms. The Service is a B2B product intended exclusively for business, professional, and commercial use. You represent that you are acting on behalf of a business entity. The Service is not directed to children under 16, and you agree not to use it on websites directed at children.
1. What the service is
We are a provider and integrator of Google Vertex AI, not a developer of language models. Answers are generated by Google's AI from your site's indexed content. We do not control or guarantee the specific content of answers produced by Google's models.
2. Subscription and billing
The service is prepaid: the Start plan ($15/mo, $144/yr) or Pro plan ($39/mo, $374/yr), each with a fixed volume of searches included; queries above the limit are billed separately ($0.02 per query). Payments are handled by Paddle (Merchant of Record): applicable taxes/VAT are included and remitted by them, and we don't store card details. Paid periods and consumed queries are non-refundable except where required by law.
3. Acceptable use
You must not:
- circumvent limits and quotas, abuse the service in an automated way, or artificially drain another party's budget;
- submit prohibited, illegal, or rights-infringing content;
- attempt prompt injection, extract system instructions, reverse engineer, or resell the service;
- use the service in violation of the Google Generative AI Acceptable Use Policy.
- use the service for high-risk AI use cases (such as automated decision-making, credit scoring, or medical diagnosis);
- index or reproduce copyrighted content that you do not own or have the right to use.
4. AI answers: accuracy and responsibility
Answers are generated by artificial intelligence and may be inaccurate, incomplete, or out of date, even when they appear authoritative. You are responsible for independently verifying answers before relying on them. Answers are not professional advice (legal, medical, financial, etc.). We are not liable for decisions made on the basis of AI answers.
5. Reliance on Google services
The service runs on Google Cloud and depends on Google's availability, changes, and terms. Your use is subject to Google's applicable terms (Google Cloud Platform Terms, Service Specific Terms for Discovery Engine/Vertex, and the generative-AI terms). We are not responsible for outages, changes, discontinuation, or content caused by Google's services. Google's commitments apply directly under its terms.
Force Majeure: Any downtime or data loss caused by failures in third-party infrastructure (like Google Cloud) is a Force Majeure event and not a breach of these Terms.
6. Disclaimer of warranties
The service and answers are provided "as is" and "as available", without warranties of any kind — express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free operation or availability; there is no separate SLA unless agreed in a separate contract.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or punitive damages, lost profits, loss of data, or loss of reputation. Our aggregate liability is limited to the greater of the fees you paid for the service in the last 12 months or $100. These limits do not apply to what the law prohibits excluding: gross negligence, willful misconduct, death or personal injury, and mandatory consumer rights.
8. Indemnification
You will indemnify us against third-party claims related to: your site content and its indexing; your use of the widget and the queries of your visitors; and your breach of these terms or of third-party rights.
9. Data and privacy
Data processing is described in the Privacy Policy. You are the controller of your visitors' data and your content; we and Google are processor and sub-processor. Under its enterprise terms, Google does not use Vertex AI/Gemini data to train its models.
10. Changes, termination, governing law
We may update the terms and the service's features; material changes will be announced in advance. Either party may stop using the service; access may be suspended for breach of these terms.
Governing law and jurisdiction. These terms are governed by the laws of the State of Israel; disputes are subject to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa. This choice of law and forum does not deprive a consumer of the mandatory rights afforded by the law of their country of habitual residence, and does not override obligations under the GDPR, the CCPA, or other applicable data-protection laws; processing of personal data is governed by the Privacy Policy and the Data Processing Agreement (DPA).
